Terms of Use

The ground rules for using MotoMotors.

Only the German version is legally binding. This translation is provided for convenience only.

1. Scope

These Terms of Use apply to the use of the MotoMotors platform (hereinafter the “Platform”), operated by Jonas Chyba. By registering, you accept these terms.

2. Description of services

MotoMotors enables motorcyclists to create a profile, find other riders in their region, follow them, exchange messages via direct message, found or join crews (groups), plan joint rideouts (outings), and take part in the community vote “Picture of the Month”. MotoMotors is a non-commercial, private community project with no intention of making a profit. Use is and remains free of charge; no advertising is displayed and no services are offered for payment. There is no entitlement to uninterrupted availability; maintenance, further development or disruptions may temporarily restrict operation.

3. Registration, approval & account

  • Use requires a minimum age of 16 years.
  • You sign in with a username of your choice and a password (at least 8 characters). An email address is not required for registration.
  • New accounts are manually reviewed and approved. Until approval, your account is restricted (e. g. you cannot yet connect with others).
  • Your information must be truthful. As a rule, one account per person is intended.
  • You are responsible for keeping your login details confidential and are liable for activities under your account.

4. Your content

You are solely responsible for the content you post (e. g. profile details, bio, messages, crew content, uploaded images). You warrant that you hold the necessary rights to it and do not infringe any third-party rights (copyright, trademark, personality rights). You retain your rights to your content and merely grant us the simple, revocable right to store and display it as part of operating the Platform.

5. Direct messages

  • Messages are intended for the respective conversation partners. Harassment, threats, spam and unsolicited advertising are prohibited.
  • You can edit or delete your own messages within 5 minutes. You can report received messages.
  • In the event of a report, the affected conversation is transmitted to moderation/support for review (see Privacy Policy).

6. Picture of the Month (community vote)

  • You can submit one image per month and have one vote. Only upload images to which you hold the rights and on which any persons depicted have given their consent.
  • Monthly cycle: during the first two weeks (days 1–14) images can be submitted, during the following two weeks (from day 15) voting takes place. After the month ends the winner is fixed; their image stays visible until a new winner is determined.
  • Whoever wins a month pauses the following month and cannot submit an image that month (voting is still allowed) – so others get a chance too. Participation is possible again from the month after.
  • Manipulation of the vote (e. g. multiple accounts, purchased/automated votes) is prohibited and leads to exclusion.
  • By taking part, you agree that your submitted image may be displayed as part of the vote and that the winning entry may be published on the homepage as well as on our Instagram channel (@motomotorsde) – in each case naming your profile name. You can revoke this consent at any time with effect for the future.

7. Crews & rideouts

  • Crews are founded and managed by users. The creator (“Boss”) and officers appointed by them are responsible for the content, member management and rideouts of their crew.
  • Rideouts are organised solely by the respective crew and its operator, who is thereby the sole organiser and bears full responsibility. MotoMotors is neither an organiser nor a travel provider and assumes no organisation, supervision or liability for outings, their execution or any damage arising from them. Our rideout liability terms apply.
  • The crew operator ensures the ride complies with the statutory requirements of the respective country – in particular any required permits or notifications for larger or publicly advertised events, as well as adequate insurance cover.
  • The road traffic regulations and all legal requirements apply. Calls for illegal races or dangerous behaviour are prohibited. Participation is at your own responsibility and risk.

8. Rules of conduct

Our Community Guidelines. apply to how we interact with one another. In particular, illegal, insulting, harassing, violence-glorifying or youth-endangering content, spam and impersonating another identity are prohibited.

9. Moderation & measures

In the event of violations of these terms or the Community Guidelines, we may remove content (e. g. profile picture, bio, images, messages, crew content), warn accounts, temporarily suspend them or permanently close them – graduated according to the severity of the violation.

10. Availability & changes

We may further develop the Platform, change or discontinue features. We will inform you of material changes to these terms in an appropriate manner; continued use is deemed to be acceptance of the respective current version.

11. Liability

We are liable without limitation in cases of intent and gross negligence as well as for injury to life, body or health. In the case of simple negligence, we are only liable for the breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical for the contract. We assume no liability for the content and conduct of other users or for rideouts organised by users.

12. Termination / deletion

You can delete your account yourself at any time in the Settings or request deletion by message to business@motomotors.de We may terminate the usage relationship with immediate effect in the event of repeated or serious violations.

13. Final provisions

The law of the Federal Republic of Germany applies. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
